These Terms are being finalized ahead of Gift of Moments' public release. The effective date will be set when they are approved and published for that release.

Agreement to these terms

These Terms of Use ("Terms") govern your use of the Gift of Moments mobile app (the "app") and this website, provided by USA Raja Creator Tools, operated by RAJ CREATIONS LLC ("we," "us," or "our"). By using the app or this website, you agree to these Terms. If you don't agree, please don't use the app or this website.

Your content

You keep ownership of the photos, videos, voice recordings, captions, and other content you use in Gift of Moments. In return, you confirm that you own, or have permission to use, every photo, video, voice recording, piece of music, and any other content you add to the app. You are solely responsible for the content you create and for anything you choose to share.

Music and copyright

Using Gift of Moments does not grant you any rights to copyrighted music beyond what you already have. The app does not give you permission to use music you don't have the rights to, even if the app allows you to technically import an audio file. Acceptable use

When using Gift of Moments, you agree not to create or share content that is unlawful, abusive, harassing, infringing, or otherwise harmful to others. We may suspend or restrict access to the app for anyone who misuses it.

What happens after you share a video

Once you export and share a video outside the app — for example, on a social media platform — that platform's own rules apply. Platforms may review, mute, block, demonetize, or remove content, including content you made with Gift of Moments, entirely at their own discretion and outside of our control.

Changes to the app

We may update, change, add, or remove features of Gift of Moments over time, and we may also change or discontinue the app or this website. We'll try to give reasonable notice of significant changes where practical, but we can't guarantee the app or any specific feature will always be available.

Purchases and refunds

Gift of Moments does not currently have any purchases, subscriptions, or paid features implemented. If we introduce purchases in the future, they will be processed by the applicable app marketplace (the Apple App Store or Google Play) under that marketplace's own payment and refund rules, and we will publish the specific terms here before any purchase feature goes live.

Warranty disclaimer

Gift of Moments and this website are provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

Limitation of liability

To the fullest extent permitted by law, RAJ CREATIONS LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Gift of Moments or this website, including loss of data, content, or goodwill.

Termination and restricted use

We may suspend or terminate your access to Gift of Moments if you violate these Terms or use the app in a way that could harm us, other users, or third parties. You may stop using the app at any time by uninstalling it.

Governing law

The governing law for these Terms is still being finalized and will be added here before Gift of Moments' public release.

Changes to these terms

We may update these Terms from time to time. We will revise the effective date above when we do, and continuing to use the app or this website after changes take effect means you accept the updated Terms.
